Daubert and Frye tracking

Your admissibility record and how the rate is calculated.

Record every Daubert, Frye and motion in limine challenge to your testimony, including the ones you won. Case caption, challenge type and outcome are required; everything else can be added later.

HOW THE FAVORABLE RATE IS CALCULATED

Admitted plus partially excluded, divided by resolved challenges. Resolved means admitted, excluded or partially excluded.

Withdrawn and pending challenges are excluded from both the top and the bottom of that fraction. Neither is a court judgment on your testimony, so counting them either way would misstate the record you are handing to opposing counsel.

With no resolved challenges the rate reads as a dash, never a flattering 100%. If every resolved challenge went against you it reads 0%, which is a real figure and different from having no data.
